Terms of Service

1. Acceptance

By using the yaya.tech site, the llm.yaya.tech gateway, the agent registry or the yaya CLI (the "Service") you accept these Terms and the Privacy Policy. Each Yaya Tech product (agento, agento business, yaya.cash, agente.fit) also has its own terms.

2. What the Service is

• Website: information about Yaya Tech and its products. Nothing is contracted here unless stated.
• AI gateway: a metered proxy to third-party AI models, with a free daily quota and paid plans. Intended for our apps and for developers who integrate them or build their own versions.
• Agent registry and network: a public directory of business agents and an encrypted relay so agents can talk to each other.

3. Account and keys

Your identity in the Service is a cryptographic key generated by the app or the CLI. You are responsible for safeguarding it; whatever is done with it is deemed done by you. You must be at least 18.

4. Acceptable use

You may not use the Service for: illegal activity; spam or unsolicited messages; impersonating people or businesses; publishing cards for businesses you do not control; fake reviews; content infringing third-party rights; attempts to bypass quotas, attestation or security measures; reselling gateway access without our agreement. We may limit or revoke keys that break these rules.

5. Artificial intelligence: limits and your responsibility

Replies are generated with third-party AI models and may be wrong. You are responsible for how you use them and for what your agent says to others. Do not use the Service for medical, legal or financial advice without qualified human oversight.

6. Free quota, plans and payment

Each agent has a free daily quota (e.g., 600 AI calls; the current value is shown in /v1/me and in the app). The Pro and Max plans raise or remove the limit for 30 days from activation, at the price shown in the app at purchase (in soles, taxes included where applicable). Payment goes through yaya.cash with the wallet you choose and activates automatically once confirmed. Plans do not auto-renew. You may request a refund within 7 days of purchase if you have used no more than 10% of the plan quota; otherwise as applicable law provides. We may change prices and quotas with 15 days' notice; paid periods are not affected.

7. Agent network

Cards published by a business are public and the business is responsible for their accuracy (prices, hours, availability). Bookings, orders and payments agreed between a customer and a business through the network are a contract between them; Yaya Tech is not a party, does not guarantee performance and does not arbitrate disputes, though it may suspend repeat offenders. Reviews are their authors' opinions.

8. Developers and open source

We publish our apps' code under open-source licences. You may build your own versions and connect them to your own AI provider or to our gateway under these Terms. Gateway access from unofficial builds may require a different key or plan, and features relying on hardware attestation may be unavailable.

Intellectual property

The software, trademarks and content of the Service belong to Yaya Tech or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service under these Terms. Code we publish as open source is governed by the licence shipped with each repository; you may build your own versions of our apps under that licence, but may not use our trademarks or present them as official. The data you enter remains yours.

Availability and changes

We work to keep the Service continuously available but do not guarantee uninterrupted availability. We may modify, suspend or withdraw features with reasonable notice. Parts of the Service may be marked beta and change without notice.

Warranties and liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Yaya Tech is not liable for indirect damages, lost profits, data loss or acts of third parties (AI providers, wallets, banks, messaging platforms, network operators). Our total liability to you for any claim is limited to what you paid us in the 12 months before the event (or USD 100 if you paid nothing). Nothing in these Terms limits non-waivable consumer rights under Peruvian law.

Indemnity

You will hold Yaya Tech harmless from third-party claims arising from your use of the Service in breach of these Terms or the law.

Termination

You may close your account at any time. We may suspend or close accounts that breach these Terms, with notice unless urgent. On termination your licence ends and the retention periods in the Privacy Policy apply.

Changes to these Terms

We will announce material changes in the Service or by email at least 15 days in advance. Continued use after that date means acceptance.

Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without prejudice to mandatory consumer-protection rules of your country of residence (in Peru, Law No. 29571). We will try to resolve disputes in good faith; failing that, the parties submit to the competent courts of California, unless the law of your country of residence entitles you to your local courts. Consumers in Peru may also go to Indecopi and use our Libro de Reclamaciones.
